Welcome to the Fee Thompson website! By accessing or using our website located at feethompson.com (the "Site"), you agree to comply with and be bound by the following Terms and Conditions (the "Terms"). If you do not agree to these Terms, please do not use the Site.

1. Intellectual Property

1.1 Ownership: All content on the Site, including but not limited to artwork, images, text, graphics, logos, and other materials (collectively, "Content"), is the property of the Artist or third parties and is protected by copyright, trademark, and other intellectual property laws.

1.2 Use of Content: You may view, download, and print Content for personal, non-commercial use only. Any other use, including but not limited to copying, reproducing, distributing, or displaying Content for commercial purposes, is prohibited without prior written permission from the Artist.

2. User Conduct

2.1 Prohibited Activities: You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site. Prohibited activities include, but are not limited to, transmitting any viruses, malware, or other harmful code, and engaging in any form of data scraping or extraction.

2.2 User-Generated Content: If you submit any content to the Site (e.g., comments, reviews), you grant the Artist a perpetual, non-exclusive, royalty-free, and worldwide license to use, reproduce, modify, and display such content. You are solely responsible for the content you submit and must ensure that it does not violate any third-party rights or applicable laws.


3. Purchases and Payments

3.1 Pricing: All prices for artwork, merchandise, or other products and services offered on the Site are listed in New Zealand dollars and are subject to change without notice.

3.2 Payment: Payments for purchases made on the Site are processed through Squarespace, and you agree to comply with the terms and conditions of the payment processor.

3.3 Refunds: All sales are final unless otherwise specified. Refunds or exchanges will be handled on a case-by-case basis and this process will be guided by the 'Refund Policy’ text below.

4. Links to Third-Party Sites

The Site may contain links to third-party websites or services that are not owned or controlled by the Artist. We are not responsible for the content or practices of any third-party websites. By using these links, you acknowledge that we are not responsible for any loss or damage that may arise from your use of third-party sites.

5. Limitation of Liability

To the fullest extent permitted by law, the Artist shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Site or the Content, even if the Artist has been advised of the possibility of such damages.

6. Indemnification

You agree to indemnify, defend, and hold harmless the Artist and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site, your violation of these Terms, or your infringement of any third-party rights.

7. Modifications

The Artist reserves the right to modify these Terms at any time. Any changes will be posted on this page with an updated effective date. Your continued use of the Site after any changes constitutes your acceptance of the new Terms.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or your use of the Site shall be resolved in the courts of New Zealand.

9. Refund policy

I have a 7 day return policy which means you have 7 days after purchasing your item to request a return. To be eligible for a return, your item must be in the same condition that you purchased/received it, unbroken/damaged and in its original packaging. You’ll also need the receipt or proof of purchase.

9.1 Damages and issues
Please inspect your order at purchase/pick-up to make sure there is no damage before leaving the gallery (i.e., on edges on frames).
If couriered, upon receipt, contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.


9.2 Exceptions / non-returnable items
Certain types of items cannot be returned like custom works (such as special orders or personalised items). Please get in touch if you have questions or concerns about your specific items.
Unfortunately, we cannot accept returns on sale items.
General wear and tear: Our Returns Policy does not cover accidental glass breakages.
No refund for change of mind purchases: Unfortunately, we do not offer refunds if you change your mind on your purchase so please select your products carefully. We may be able to exchange the item for you instead.

9.3 Exchanges
The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.

9.4 Refunds
We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded online to your nominated bank account. Please remember it can take some time for your bank or credit card company to process and post the refund too.
